1. Who these terms are with
These terms govern your use of fidgetlabs.io and the free tools we publish on it. They are between you and:

Paid engagements are governed by a separate signed agreement. Where that agreement and these terms disagree, that agreement wins.
2. Using this site
You may read, quote and link to anything published here. If you quote us, attribute it and link back.
You may not use this site to break the law, to attempt to gain unauthorised access to any system, to scrape it in a way that degrades it for other people, or to misrepresent your identity when contacting us.
3. The free tools
The EU AI Act Risk Check and the MACH & AI Readiness Assessment are provided free and as-is.
They are informational. They are not advice. The AI Act Risk Check applies a published rule set to the answers you give and tells you which risk tier those answers point to. It is not legal advice, we are not a law firm, and a result from it is not a compliance assessment. Get counsel for the legal call.
We try to keep the regulatory dates and thresholds in those tools accurate and we correct them when they change, but we do not warrant that they are current at the moment you read them.
Nothing you do with these tools creates a client relationship.
4. Intellectual property
The content of this site, including Focal Point articles, diagrams and the tools themselves, belongs to Fidget Labs B.V. unless stated otherwise.
Third-party trademarks and logos shown on this site belong to their owners. They appear as nominative use to describe platforms we work with, and their appearance does not imply endorsement, partnership or certification unless we say so explicitly.
The CrawlIndex dataset is published separately under CC BY 4.0 and its own licence applies.
5. Content you send us
If you send us an enquiry, a message, or answers to a tool, you keep ownership of it. You give us permission to use it to respond to you and to run the service you asked for. See the Privacy Policy for what we do with personal data.
Do not send us confidential information through a web form. Use a call, or ask us for a suitable channel first.
6. Availability
We do not promise the site or the tools will be available without interruption. We may change or withdraw any free tool at any time.
7. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that: the free tools and the content of this site are provided without warranty, and we are not liable for any loss arising from decisions you take based on them. Liability under a paid engagement is governed by the agreement for that engagement.
If you are a consumer, your statutory rights under Dutch and EU consumer law are unaffected by these terms.
8. Links out
We link to other sites, including our own products on separate domains. We are not responsible for their content or their privacy practices.
9. Governing law
These terms are governed by the law of the Netherlands. Disputes are subject to the exclusive jurisdiction of the competent court in the Netherlands, save that if you are a consumer you may also bring proceedings in the courts of your country of residence.
10. Changes
We may update these terms. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
